This agreement is between you and Caueh Vidal, trading as Swissperiences (“we”, “us”), and covers the NosyPup app for macOS (the “App”). By installing or using the App, you agree to it. If you don’t agree, don’t install or use the App.
Who sells it. Purchases are processed and sold by Stripe via Link, as reseller and merchant of record; Link handles payment, taxes, receipts and transaction support. The license to use the App is granted by Caueh Vidal, trading as Swissperiences.
1. Your license
- Free trial. You may use the App free for 14 days, starting the first time you turn protection on.
- Personal license. When you buy, we give you a personal, non-exclusive, non-transferable license to use the App on up to 2 Macs that you own or control. You can move it to another Mac by deactivating one first.
- Updates. Your license includes updates for the current major version. Future major versions may be offered separately.
2. What you may not do
You may not share, sell or rent your license key, bypass the trial or the license check, or copy, modify or reverse-engineer the App except where the law allows it.
3. You are responsible for how you record
Recording people is regulated by law. You are solely responsible for using the App lawfully: only point it at spaces you are allowed to monitor, tell people they may be recorded where the law requires it, get consent where needed, and don’t record others without notice where that isn’t allowed (for example, employees, guests or neighbors). We don’t check how or where you use the App.
4. What the App is, and isn’t
- The App runs on your Mac. Person detection happens on your Mac, and alerts go from your Mac to your own Telegram bot.
- It is not a certified alarm or monitoring service, and it doesn’t contact the police or anyone else.
- It only works while your Mac is open, awake, powered and connected. Alerts depend on the internet and Telegram, and can be delayed or not arrive. Detection can miss people or alert when no one is there.
5. License check and privacy
To activate and occasionally confirm your license, the App sends your license key and a code derived from your Mac (not its serial number) to our license server. The App doesn’t send your photos, videos or camera images to us. See our Privacy Policy.
6. Ownership
The App is licensed, not sold. We and our licensors keep all rights in it, including the NosyPup name and illustrations.
7. Refunds and ending this license
You can get a full refund within 14 days of purchase (see our Refund Policy); refunds are issued by Stripe. If your purchase is refunded, or if you seriously break this agreement, your license ends. You can stop using the App and delete it at any time.
8. Disclaimer
Apart from the above and to the extent the law allows, the App is provided “as is” and “as available”, without warranties of any kind, including that it will be uninterrupted, error-free or detect every event.
9. Limitation of liability
To the extent the law allows, we’re not liable for indirect or consequential losses, or for losses caused by events the App didn’t detect or alerts that didn’t arrive, and our total liability is limited to the amount you paid for the App. Nothing in this agreement limits liability for intent or gross negligence, for death or personal injury, or any rights you have as a consumer that can’t be limited or excluded by law.
10. Governing law
This agreement is governed by Swiss law. If you are a consumer, this doesn’t take away the protection of the mandatory laws of the country where you live, and you may bring a claim in the courts where you live.
11. Changes and contact
We may update this agreement for future versions; the date at the top shows the latest version. Questions: hello@nosypup.com.
